Terms of Service

These Terms of Service ("Terms") govern your access to and use of GoPostAuto (the "Service"), operated by GoPostAuto ("we", "us", or "our"). Please read them carefully.

1. Acceptance of Terms

By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of the Service

GoPostAuto is an AI-powered marketing platform that helps you generate, schedule, approve, and publish content to third-party social platforms including Facebook, Instagram, and LinkedIn, and view engagement metrics for content you publish.

3. Accounts and Eligibility

You must be at least 16 years old (or the minimum age required in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date.

4. Acceptable Use

You agree that you will not, and will not permit others to:

• Send spam or unsolicited bulk messages, or engage in inauthentic or deceptive behavior.
• Scrape, harvest, or collect data from any platform except as expressly permitted.
• Post illegal, infringing, defamatory, hateful, or otherwise objectionable content.
• Violate the intellectual property or privacy rights of others.
• Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.
• Use the Service in any way that violates the platform policies of Meta (Facebook and Instagram) or LinkedIn, including their Platform Terms, Community Standards, and Developer Policies.

You are solely responsible for ensuring your use of connected social accounts complies with the applicable platform's terms. Violations may result in suspension of your account.

5. Your Content and License

You retain all ownership of the content you create or upload ("User Content"). We do not claim ownership of your content. You grant us a limited, non-exclusive, worldwide license to host, process, and transmit your User Content solely to operate the Service and to publish that content to the social accounts you connect, at your instruction. This license ends when you delete the content or your account, except where retention is required by law.

6. AI-Generated Content

The Service uses AI to help generate content. AI output may be inaccurate, incomplete, or unsuitable. You are solely responsible for reviewing, editing, and approving all content before it is published, and for everything you choose to publish. We make no warranty regarding the accuracy, legality, or fitness of AI-generated content.

7. Subscriptions, Billing, Refunds, and Cancellation

• Paid plans are billed in advance on a recurring basis through our payment processor, Stripe.
• Fees are non-refundable except where required by law or expressly stated.
• You may cancel at any time; cancellation takes effect at the end of the current billing period, and you retain access until then.
• We may change pricing with reasonable advance notice, effective on your next billing cycle.

8. Service Availability

We strive to keep the Service available but do not guarantee uninterrupted or error-free operation. The Service depends on third-party platform APIs (including Meta and LinkedIn) that are outside our control; we do not guarantee the availability, performance, or continued access of any third-party platform API, and we are not liable for failures, delays, or changes caused by those platforms.

9. Suspension and Termination

We may suspend or terminate your access to the Service if you violate these Terms, create risk or legal exposure for us, or for prolonged inactivity. You may stop using the Service and delete your account at any time from Settings, as described in our Data Deletion Instructions.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

11. Limitation of Liability

To the maximum extent permitted by law, GoPostAuto and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total aggregate liability arising out of or related to the Service will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless GoPostAuto and its affiliates from any claims, damages, liabilities, and expenses arising from your User Content, your use of the Service, or your violation of these Terms or any third-party platform policy.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which GoPostAuto is established, without regard to conflict-of-laws principles. Courts located in that jurisdiction will have exclusive jurisdiction over any disputes, subject to any mandatory consumer protections in your place of residence.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
